Johnson referenced a press release from the lead Democrat negotiator, Sen. Chris Murphy (D-CT), who accurately identified that “the border by no means closes” below the bipartisan deal.
Murphy touted a “requirement” within the invoice for “the President to funnel asylum claims to the land ports of entry when greater than 5,000 individuals cross a day. The border by no means closes, however claims have to be processed on the ports. This enables for a extra a extra orderly, humane asylum processing system.”

But his put up is deceptive. The edge to allow the declaration of a brand new emergency authority shouldn’t be 5,000 migrant encounters per day, however 8,500. It could take a median of 5,000 migrants crossing per day over seven days to set off the secretary’s authority to declare an emergency.
And regardless of Murphy’s declare, the language within the invoice reads that the secretary “shall” activate the border authority, not “should.”
Additional weakening the language, the president has the authority to waive the declaration for 45 days.
Regardless of Johnson stating emphatically that the invoice will go nowhere within the Home, Senate Majority Chief Chuck Schumer (D-NY) is anticipated to start pulling procedural triggers Monday to allow votes on the invoice this week.
